This Privacy Policy (“Privacy Policy”) is designed to help you understand how General Cable Corp. and its affiliates (“General Cable”, “we”, “our” or “us”) collect and use the information, including Personal Data (as this term is defined in Section 1), that you share when you use www.generalcable.com and its associated domains (together, the “Site”). It also describes the choices available to you regarding our use of your Personal Data and how you can access and update this information.

1. Scope of this Policy and your use of the Site

General Cable collects and uses your Personal Data (e.g., your name, mailing address, email address, telephone number, financial information and business profile) to provide you with useful information and material to improve our services and this website, and to contact you for business related purposes. We also collect non-personal-data like the type of browser and operating system you use and other details associated with the devices you use to access our website. Except where otherwise expressly indicated in this Privacy Policy or on the Site, this Privacy Policy applies to any information collected on the Site and any information that we receive from you off-line. If you prefer that we not collect your Personal Data, please do not provide it to us. When you submit your Personal Data and other information on the Site, you hereby consent to the collection, use and disclosure of such information as set forth in the Privacy Policy. By using or accessing the Site, and/or communicating with a General Cable agent via mail, email or telephone you are accepting the practices described in this Privacy Policy. You are responsible for submitting accurate information to the Site.

2. We are fully committed to the EU/U.S. Privacy Shield

We comply with the U.S.–EU Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and any other processing of your Personal Data from European Union member countries or the European Economic Areas (EEA). If there is any conflict between any statement in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. 3. What Personal Data we collect and where we store them

When you visit an Internet website, you disclose certain information about yourself such as your Internet Protocol (IP) address, the time of your visit and the referring location (the site or page that offered a link to the Site). Information we collect includes browser information, operating system information, and the date, time, length of stay and specific pages accessed during your visits to the Site. Click-stream data may include such information as the page requested, the source of the request, the preceding page viewed and the type of browser making the request.  Site also collects Personal Data about you that you provide to us voluntarily, such as through the "Contact Us" section.

General Cable may also collect information regarding the type of device you use, operating system version, the device identifier (or “UDID”), and associated services from your mobile device. Please refer to our separate Cookie Policy on our Site for further details.

We maintain one or more databases in the United States to store your Personal Data and may retain it as reasonably required to fulfill the purposes identified below.

4. Why we collect these Personal Data and how we may share them

Personal Data will be used to help us improve our Site, get in touch with you, to familiarize you with new products and services, to send you information, and for our planning, marketing and strategic information purposes. We may use your Personal Data to customize, analyze, adjust and improve the Site and our services to better meet your needs and to facilitate communication between General Cable and you.  We may also use some of the information to provide you with important updates regarding the Site and services, such as changes to this Privacy Policy, our Terms of Use and our other policies.

We don’t sell your Personal Data to third parties.  We may, however, share Personal Data in the following cases:

(a) Personal Data may be disclosed or otherwise transferred as necessary to third parties under contract with us to improve and provide services associated with the Site. Examples include, but are not limited to, customer support specialists and web hosting companies.

(b) In addition, we may provide your name and postal and email address to select companies for our marketing purposes, unless you opt out of this use. We may use your Personal Data for our newsletters or emails about our products and services (this information contains a subscriber link allowing you to opt out).

(c)  When you visit our Site, we may collect click-stream data for purposes of our system administration.

(d) We may disclose any information, including, without limitation, Personal Data, we deem necessary, in our sole discretion and without your prior permission, to comply with any applicable law such as to comply with a subpoena, regulation, orders of a data protection agency, legal process or governmental request. General Cable reserves the right to disclose your Personal Data if we believe you have or are violating our policies, or in order to protect or defend General Cable’s rights or property, even without a subpoena, warrant or other court order.

(e) Personal Data may be disclosed or distributed to another party with which General Cable enters, or may reasonably enter, into a corporate transaction, such as for example, a merger, consolidation, acquisition or asset purchase. In the unlikely event of a bankruptcy, insolvency or liquidation, the database containing Personal Data may be treated as an asset of General Cable and may be subject to transfer to a third party.
 
5. Data Security

We maintain a variety of commercially reasonable safeguards designed to protect your Information from unauthorized access and disclosure. For example, we use industry accepted tools and techniques to protect against unauthorized access to our systems. But we have no control over the security of other websites or applications that you might visit or use even when a link to those websites or applications is available through the site. If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your computer or device when you have finished your session. This will help to ensure that others cannot access your Personal Data.

We want you to feel confident using the Site; however, no system can be completely secure. Therefore, although we take commercially reasonable steps to secure and protect your Personal Data and communications, we do not promise, and you should not expect, that your Personal Data or other communications always will remain secure. In the event of a breach of the confidentiality or security of your Personal Data, we will notify you if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address we have on record for you. You should also take care with how you handle and disclose your Personal Data. 6. Our links to other websites

This Site contains links to other websites. If you access a third party site from a link on this Site, any information you disclose on that site is not subject to this Privacy Policy. It is your obligation to review and understand the privacy practices and policies of these other websites.

7. Note for Site users from outside of the United States

Sites are hosted in the United States and are governed by United States law. If you are outside the United States when you visit the Site or engage in communications with a General Cable agent via mail, e-mail or telephone in connection with the Site, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Site and/or communicating with a General Cable agent via mail, email or telephone, you consent to your information being transferred to our facilities in the United States and to the facilities of those third parties with whom we share it as described in this Privacy Policy.

8. No Services for Minors

We do not knowingly collect information from minors. To use the Site, you must be the age of legal majority in your place of residence. By using the Site, you hereby represent that you are at least the age of legal majority in your place of residence. We do not use an application or other mechanism to determine the age of users of the Site and to provide any services. All information provided to General Cable will be treated as if it was provided by an adult. If, however, we learn that a minor has submitted information about himself/herself to us, we will use commercially reasonable efforts to delete the information as soon as practicable.

9. Note for California Residents

California law permits individuals who provide General Cable with Personal Data and who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. General Cable does not, at this time, disclose Personal Data to third parties for their direct marketing purposes. If General Cable changes this policy, we will update this provision and provide instructions on how you may make a request for details concerning such information.

10. Do Not Track Disclosure 

While there are many ways in which web browser signals and similar mechanisms can indicate your choice to disable tracking, we may not be aware of or able to honor every such mechanism. Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” (DNT) signals other than cookies, we may not respond to undefined DNT signals to our websites or online services. 11. Your Options to Opt-Out and to Inquire What Personal Data We Store About You

If you tell us that you do not want us to use your Personal Data to contact you, General Cable will comply with the applicable law. You may opt out of having your Personal Data used by the Site for disclosure to third parties. To do so, please contact GeneralCable.com via email at the following address: info@generalcable.com. In addition, at your request, via email, GeneralCable.com will provide you a summary of the personal data it has regarding you. Should you wish to modify, correct, change or update any of the information, you should contact us at: info@generalcable.com. Please note that if you use more than one name or e-mail address when communicating with General Cable or using the Site, you may continue to receive communications from General Cable to any name and/or email address not specified in your opt-out request.

12. How long we keep your Personal Data

We will retain your Personal Data for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, to resolve disputes, for business-related reasons and to enforce our agreements.

13. Governing Law and Dispute Resolution

For non-EU/European Economic Area users, this Privacy Policy and the resolution of any dispute arising hereunder shall be governed and construed in accordance with the laws of Kentucky without reference to its conflicts-of-laws provisions.

14. Severability

The invalidity or unenforceability of any provisions of this Privacy Policy in any country shall not affect the validity or enforceability of any other provision of this Privacy Policy, which shall remain in full force and effect.

15. Modifications

General Cable may occasionally change its Privacy Policy to reflect changes in its practices. All changes will be posted on www.generalcable.com, and we will revise the effective date at the top of this Privacy Policy.  If we make any material changes to our Privacy Policy, we will notify you by sending an e-mail to the e-mail address(s) you provided to us, and by prominently posting notice of the changes on the Site prior to the change becoming effective. We will give you an opportunity to opt-out of any materially changed Privacy Policy or alternatively, delete the information you have provided to us. We recommend that you check the Site from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies and to make sure we have your most up-to-date email address.  Any non-material changes to the Privacy Policy will not be sent to you via email; a notice of such non-material changes will be posted on the Site; and your continued use of the services and Site after such revised Privacy Policy is posted shall constitute your acceptance of such revised Privacy Policy.
